Sumario: Desde la aprobación del Real Decreto-Ley 19/2012, de 25 de mayo, de medidas urgentes de liberalización del comercio y de determinados servicios, que introdujo en nuestro ordenamiento jurídico la figura del contrato Gobierno a Gobierno, no se ha procedido a la firma de ningún contrato de este tipo. El presente trabajo tiene por finalidad analizar las causas y la regulación del contrato Gobierno a Gobierno así como su relación con la normativa de otros países de nuestro entorno para valorar si se trata de una normativa eficaz, de modo que la falta de suscripción de este tipo de contratos responda exclusivamente a la complejidad que caracteriza a las transacciones relacionadas con el material de defensa (por razones políticas, económicas o tecnológicas) o si dicha normativa puede mejorarse con la finalidad de facilitar las suscripción de este tipo de contratos. Para la realización del presente trabajo se han estudiado los modelos que ofrece el derecho comparado, especialmente el modelo Foreign Military Sales (en adelante o en lo sucesivo FMS) norteamericano, la naturaleza jurídica del contrato Gobierno a Gobierno y su encuadramiento dentro de la normativa comunitaria y los principales aspectos de su régimen jurídico, para concluir que se trata de una normativa necesaria para garantizar el mantenimiento de las capacidades industriales estratégicas para la Defensa Nacional pero que admite posibilidades de mejora en cuanto a su regulación.
